I wonder how much  of that is damage  vs lost revenue.   I presume if the room is unavailable while its being fixed up the hotel can demand the hotel guest pay for the lost room revenue...and the hotel is probably charging the most expensive rate...and taking heir sweet time getting the room back online. ;)

I doubt they could claim the room unless the hotel was completely sold out.  I don't doubt that they would try to get that, but I don't think they could get it without the hotel being completely booked.

Car rental companies are rather infamous for pulling the whole "loss of use" thing if you get into an accident and don't have their insurance.  Same deal applies that they have to prove that there weren't other vehicles available, but they try to claim it anyway.
